| 我国自贸试验区负面清单的外资管理模式在本质上给外资和内资企业创造了公平竞
争的市场法制环境，这种管理模式顺应了国际投资规则发展的新趋势，与我国正在
进行的行政体制改革相契合。在负面清单模式下，我国政府监管体系在理念、体制
和效果上面临重重挑战。自贸试验区的设立以开放投资为起点，以开放促进改革，
政府管理由事前审批逐步转为事中事后监管，最终落实政府职能的根本性转变。负
面清单模式的完善不仅应着力于修订负面清单文本，更为重要的是建立和完善事中
事后监管制度。自贸试验区的事中事后监管在理念转变、立法完善、监管主体等方
面还存在一些问题。应该从转变监管理念、完善立法、构建信息平台、监管主体多
元化和完善社会征信体系等方面对事中事后监管制度进行完善。 |

| On the Government In-Process and Subsequent Regulation under the Negative List Management Mode in China’s Pilot Free Trade Zones |

| The negative list of foreign management mode in China’s pilot free trade zones has created a fair competition market legal environment for foreign and domestic enterprises. This kind of management pattern conforms to the new trend of the development of international investment rules, and fits to the reform of the administrative system in China. Under the negative list mode, China’s government regulatory system is facing many challenges in the idea, system and results. Pilot free trade zones are set up to open investment as a starting point and to promote the reform of the government. The government management is featured by transforming from prior approval to in-process regulation, and ultimately the implementation of the fundamental transformation of government functions. Negative list mode should not only focus on the improvement of the negative list by text, but also more important is to establish and complete the system of regulation on in-process and subsequent regulation. On current regulation in the pilot free trade zones, there are still some problems. We should take some effective measures to perfect the system of in-process and subsequent regulation in pilot free trade zones, including transformation of regulatory philosophy of change, perfection of legislation, building information platform, improving the assessment mechanism and supervision of the main aspects of the regulatory body. |
