| ISDS 仲裁员具有较为明显的身份特征、地域来源及性别特征。为解决投资仲裁员分
布不平衡的问题，ICSID 已开始尽量选择女性仲裁员或来自发展中国家的仲裁员。
当事方指定仲裁员的天然争论以及仲裁员多种身份的重复交互，导致了仲裁员之间
的感知风险、妥协风险以及偏见风险。扩大仲裁管辖权和维持ISDS 体系的利害关系
是对仲裁员的两大主要激励路径。不同当事方在ISDS 中选择仲裁员时存在不平等信
息或信息不对称的问题，导致仲裁员信息灰色市场的产生，影响ISDS 仲裁程序。仲
裁员及时彻底披露其与当事方的关系和潜在的冲突对保障仲裁员的独立性和公正性
至关重要。仲裁员的双重身份易产生争论点冲突，从而引发正当程序的问题。披露
可能产生合理怀疑的情况并制定仲裁员的行为守则可一定程度上消除这种冲突。

| Risk, Incentive and Supervision: The Identity Conflict of ISDS Arbitrator and Its Solution |

| ISDS arbitrator has obvious identity, geographical origin and gender characteristics. In order to solve the problem of unbalanced distribution of investment arbitrator, ICSID has begun to choose female arbitrators or arbitrators from developing countries. The natural arguments of the parties as well as the repeated interactions among the arbitrators, results in the risk of perception, the risk of compromise and the risk of bias. Extending the jurisdiction of arbitration and maintaining the interests of the ISDS system are the two main incentive paths for the arbitrator. Different parties in the ISDS have a problem of unequal information or information asymmetry when choosing arbitrators, which will result in the production of the gray market of the arbitrators and influence on ISDS arbitration procedure. The arbitrators disclose the relationship with the parties and the potential conflict in a timely and thorough manner is very important to guarantee the independence and impartiality of the arbitrators. The dual identity of the arbitrator is prone to make disputes conflict, which will lead to the problem of due process. The disclosure of the reasonable suspicion situation and the formulation of the conduct code for the arbitrator can eliminate the conflict to a certain extent. |
