| 《跨太平洋伙伴关系协定》从闭门谈判，到举世瞩目，再到无人问津，经历了大起
大落的过程。本文对《跨太平洋伙伴关系协定》谈判的背景进行了回顾，随后对《跨
太平洋伙伴关系协定》文本进行了系统介绍，特别是从宗旨、货物贸易、服务贸易、
知识产权、投资和综合规则等方面以及从与WTO 规则对照的角度进行了研究，展现
了《跨太平洋伙伴关系协定》“先进性”和“代表性”的特征。本文认为，作为新
一代贸易与投资融合的规则，《跨太平洋伙伴关系协定》文本必将成为未来多边规
则的范本。《跨太平洋伙伴关系协定》文本不仅为未来多边贸易和投资规则指明了
发展方向，为所有参与谈判的人员提供了文本便利，而且能够成为测试各国谈判意
图的工具，因此《跨太平洋伙伴关系协定》文本研究，包括对《跨太平洋伙伴关系
协定》文本宗旨和条款的细致研读，应该得到重视和加强。 |

| A Study on the Text of TPP |

| Abstract: |
| In the past few years, TPP was negotiated in close doors, drew worldwide attention in reaching
agreement, and finally left behind by most people. This essay explores the brief history of TPP, explains its text in
a systematic way, especially from the aspects of its purpose, trade of goods, trade of service, intellectual property,
investment, and comprehensive rules and from the view of the comparison with WTO rules. This essay displays the
advancement and representativeness of TPP and tries to justify that the text of TPP, as a new generation of rules
on trade and investment, will be a model for future multilateral rules by pointing out the direction of multilateral
negotiations, providing convenience for negotiators and becoming a tool to see to intention of different countries, so
a thorough and careful study becomes necessary. |
