| 美国与其 FTA缔约国将文化产业列入负面清单，通过保留国民待遇和最惠国待遇等条约义务，平衡全面市场开放与具体产业保护之间的矛盾，为解决文化全球化与民族化之间的矛盾提供新的路径。文化产业对中国全球战略意义重大，且与美国相比不具备竞争优势。因此在中美 BIT谈判中，中国应借鉴美国缔约经验，将文化产业恰当地列入中国清单，为国内产业发展赢得空间。 |

| Abstract: |
| The United States and its FTA contracting states include the cultural industry in their negative lists, to exclude treaty obligations, to set up institutional barriers and restrict the market opening. It is a new path to solve the contradiction between cultural globalization and nationalization to achieve cultural independence and diversity. Cultural industry is of great significance to its global strategy. Meanwhile its does not have a competitive advantage compared with that of the United States. Therefore, it should be properly included in the negative list of China in the Sino-US BIT for promoting its development and enhancing its international competitiveness. |
